A Multidisciplinary Approach to The Separation of Powers

Abstract

In this study, the principle of separation of powers is taken into consideration with a multidisciplinary approach based on the fields of biology, psychology, sociology and political science. Analogy method is used and attention is drawn to the similarity between these powers and biological systems, where groups of tissues, organs are formed by the cells. Whereas in psychology, it is emphasized that human beings have the natural features called emotion, thought, will and sociability, which are expressed by such criteria as good/bad, right/wrong, benefit/harm and justice/oppression. The relations among these distinctive features/abilities is based on the sense of balance and harmony. The phenomenon of institutionalization in sociology can be explained in a similar way. In society such institutions as religion, science, economy and administration have been formed, in order to supply the needs which is generated by the human abilities. This occurrence still exists as they existed in every period of human history. In this study, it has been shown that the tissues in biology, the features in psychology, and the institutions in sociology are separated into four branches for each of these fields. In the political science, on the other hand, the powers are divided into three divisions. The presence of the fourth power is understood by multidisciplinary work, and the balance must be established between the following four organs of legislative, executive, judicial, and administrative categories. Bu çalışmada biyoloji, psikoloji, sosyoloji ve siyaset bilimi esas alınarak kuvvetler ayrılığı ilkesi multidisipliner yaklaşımla ele alınmakta, analoji yöntemi kullanılmaktadır. Kuvvetlerle biyolojide hücrelerin oluşturduğu doku grupları, organlar ve sistemler arasındaki benzerliğe dikkat çekilmektedir. Psikolojide insanın iyi/kötü, doğru/yanlış, fayda/zarar ve adalet/zulüm kriterleriyle ifade edilen his, fikir, irade ve ünsiyet/sosyallik adını alan melekelere/yeteneklere sahip olduğu üzerinde durulmaktadır. Ayrı olan bu yetenekler arasındaki ilişkiler dengeyle uyuma dayanmaktadır. Sosyolojideki kurumlaşma olgusu da benzer şekilde açıklanabilmektedir. Toplumda insan yeteneklerinin ortaya çıkardığı gereksinimleri karşılamak üzere din, bilim, ekonomi ve idare olarak adlandırılan kurumlar oluştuğu görülmektedir. Bunlar, tarihin her döneminde görüldükleri gibi halen varlıklarını sürdürmektedirler. Bu çalışmada biyolojideki dokuların, psikolojideki melekelerin, sosyolojideki kurumların dörde ayrıldığı gösterilmekte, buna karşılık siyaset biliminde kuvvetler üçe ayrılmaktadır. Dördüncü kuvvetin varlığı multidisipliner çalışma ile ortaya konulmakta, denge yasama, yürütme, yargı ve yönetme olmak üzere dörtlü ayırım ile kurulmaktadır.
